Broward’s program, still widely called the 40-year inspection, is now the Building Safety Inspection Program under Board of Rules and Appeals Policy 05-05. Under the version effective June 12, 2024, buildings require their first inspection at 25 years of age and every 10 years after. Inspections completed under the earlier 40-year program are recognized.
Broward building safety inspection at a glance
| Item | Requirement |
|---|---|
| Policy | Broward County BORA Policy 05-05 (effective June 12, 2024) |
| First inspection | 25 years from certificate of occupancy |
| Repeat | Every 10 years |
| Report prepared by | Florida-licensed professional engineer or registered architect; a threshold inspector for larger buildings |
| Report due | Within 90 days of the Notice of Required Building Safety Inspection |
| Repairs | 180 days from the report date unless the building official sets another timeframe; longer schedules possible with an active permit and approval |
| Not included | Minor structures under 3,500 sq ft gross floor area, one- and two-family dwellings, fee simple townhouses, and certain government buildings |
The 180-day repair window is the tightest in the region. Associations that line up a contractor while the engineer is still writing the report save months.
